Organizações alertam para agenda anti-indígena no Congresso Nacional

Duas organizações indígenas nacionais lançaram alertas sobre um conjunto de propostas legislativas do Congresso Nacional que colocam em risco direitos e territórios dos povos originários. A Articulação dos Povos Indígenas do Brasil (Apib) e a Coordenação das Organizações Indígenas da Amazônia Brasileira (Coiab) emitiram notas técnicas nesta semana reivindicando que essas propostas sejam arquivadas.

A Apib lista 24 atos do Senado Federal e da Câmara dos Deputados considerados retrocessos institucionais por revisarem ou revogarem “garantias históricas e direitos originários assegurados pela Constituição Federal de 1988”. Por trás dos atos, estaria uma narrativa distorcida em que indígenas são obstáculos ao desenvolvimento nacional.

A organização diz que há uma tentativa de abertura dos territórios indígenas para atividades econômicas como mineração, produção de energia, agricultura comercial e turismo. E que as iniciativas não levam em conta os direitos de consulta livre, prévia e informada, assegurados na Convenção nº 169 da Organização Internacional do Trabalho (OIT).

“O ataque aos povos originários não é somente nos territórios. Ele ocorre também por meio de quem legisla retrocessos no Congresso Nacional, arquitetando o genocídio e a devastação ambiental”, diz Dinamam Tuxá, coordenador executivo da Apib pela Articulação dos Povos e Organizações Indígenas do Nordeste, Minas Gerais e Espirito Santo (Apoinme).

 

Entre as Propostas de Emenda à Constituição (PECs) mapeadas, a Apib destaca quatro que merecem atenção especial:

  • PEC 48/2023: imposição do marco temporal de ocupação das terras indígenas;
  • PEC 59/2023: propõe a transferência da competência para demarcação de terras indígenas ao Congresso Nacional, bem como estabelece critérios e procedimentos para a realização do procedimento demarcatório sejam regulamentados por meio de lei complementar;
  • PEC 132/2015: prevê indenização para indivíduos que ocuparam áreas declaradas e homologadas como terras indígenas a partir de 5 de outubro de 2013, envolvendo tanto o pagamento da terra nua, quanto das benfeitorias realizadas, a serem indenizadas em dinheiro ou título da dívida agrária;
  • PEC 10/2024: discute a exploração econômica das terras indígenas, inclusive por não indígenas, flexibilizando amplamente o regime de usufruto exclusivo previsto no art. 231 da CF.

Já entre os Projetos de Lei (PLs), dois são destacados:

  • PL 1331/2022: autoriza a pesquisa e a garimpagem em terras indígenas por terceiros, desde que haja consentimento das comunidades afetadas.
  • PL 6050/2023: autoriza atividades econômicas em terras indígenas, como mineração, garimpo, agropecuária, turismo e geração de energia, inclusive em parcerias com empresas privadas. O projeto permite que, mesmo com a rejeição das comunidades, empreendimentos sejam aprovados por decisão da União em nome do “interesse público”.

Os dois PLs citados pela Apib também motivaram notas técnicas recentes da Coiab. Sobre o PL 1.331/2022, a organização destaca o que seria uma falsa tentativa de incluir os indígenas nos processos decisórios sobre exploração mineral.

“O PL em questão, apresentado sob o argumento de conciliar desenvolvimento econômico, segurança jurídica e participação indígena, na realidade, desvirtua a proteção constitucional, fragilizando um dos mais relevantes instrumentos de salvaguarda da dignidade e da sobrevivência cultural e física dos povos indígenas. Ao prever a autorização de exploração mineral mediante ‘consentimento’ das comunidades, o texto cria um mecanismo de pressão econômica e social, que pode transformar a consulta livre, prévia e informada em um simulacro de participação, incompatível com os padrões internacionais de direitos humanos”, diz a nota técnica da Coiab.

Em relação ao PL 6.050/2023, a Coiab refuta o argumento de que riquezas do país estão sendo usurpadas clandestinamente nos territórios indígenas e de que o modo de vida ancestral desses povos é algo imposto, idealizado por antropólogos.

“Argumentar a proposição de uma lei sobre a usurpação de ‘riquezas’ do país que estão de dentro das terras indígenas, ocasionando ameaça ao meio ambiente, afetando as comunidades indígenas e ‘empobrecendo’ o Estado, nada mais é do que uma justificativa neoliberal, que busca revitalizar o sistema econômico em crise. Amparado em um conceito de riqueza ligeiramente relacionado ao acúmulo de bens materiais e consumismo. Abre-se mão da ‘verdadeira riqueza’ dos povos indígenas e do Brasil, que são as línguas, rituais, festas, saberes tradicionais (…)”, diz a nota técnica.

    Магазин надежный репутацию оправдал сделал заказ 24 февраля , а 26 груз был уже на руках. Если и бывают задержки скорее всего это курьерские фирмы косячат. Сегодня убедился что оператор не сидит без дела, очень сильно помог мне с моим вопросом, при чем оперативно все сделал. Оцениваю данный магазин 10 из 10.     Можно. Курьер приходит всего один раз и если он не застал Вас дома, то придется идти к ним в офис с паспортом, чтоб забрать посылку.
